Sherman Jensen has served as expert witness in several high- profile environmental litigation cases.  He provided expert testimony in the fields of physical ecology, soils, classification, and riverine/riparian habitats for three Natural Resource Damage Assessments (NRDAs) in the Northwest United States.  He also provided expert testimony concerning livestock impacts to stream and riparian habitats. 

  • Sierra Club (plaintiff), versus Los Angeles Department of Water and Power.  Current case.  This case involves alleged impacts to the Owens Lake bed resulting from implementation of the Lower Owens River Project (LORP), which entails rewatering of about 53 miles of the Owens River in Inyo County, California.  Developed an ecological assessment of the Owens Lake bed to evaluate allegations of the plaintiff.
  • Private landowners (plaintiffs), versus Roosevelt City.  Current case.  The plaintiffs allege lowering of unconfined alluvial groundwater levels resulting in impacts to agricultural yields in response to a well field operated by the city of Roosevelt, Utah.
  • United States of America (plaintiff), versus ASARCO Inc, et al.  1999-2001.  This case is a Natural Resource Damage Assessment (NRDA) of mining impacts in the Coeur d'Alene River basin in northern Idaho.  An ecological classification was applied to the Coeur d'Alene, St. Joe, St. Regis and upper Spokane River basins.  Results were used to evaluate the Plaintiffs selection of control sites used to assess damages to fisheries, wildlife and riparian habitats.  Sherman testified for the defendant on physical ecology, soils, ecological classification and mapping.  
  • State of Montana (plaintiff) versus ARCO Inc, et al..  1995-1998.  This case is a Natural Resource Damage Assessment (NRDA) of mining impacts in the Clark Fork River basin in northwest Montana.  An ecological classification was applied to the Clark Fork, Big Hole, Beaverhead and Ruby River basins.  Results were used to select control sites for assessing fishery impacts.  Sherman testified for the plaintiff on ecological classification and mapping.
  • State of Idaho (plaintiff) versus Blackbird Mining Company.  1993-1994.  Another NRDA of mining impacts in Panther Creek basin in northern Idaho.  An ecological classification was conducted to select appropriate control reaches for assessing fishery impacts in Panther Creek basin.  Sherman provided written testimony for the plaintiff regarding classification and selection of control reaches.
  • Mono Lake Committee (plaintiff) versus Los Angeles Department of Water and Power.  1994.  Prepared testimony and provided council to the defendants regarding ongoing restoration of Rush and Lee Vining Creeks, tributaries to Mono Lake.  The case was settled moments before I was due to testify.
  • National Wildlife Federation (plaintiff) versus Bureau of Land Management.   Provided oral testimony for the plaintiff concerning livestock impacts to stream and riparian habitats along several tributaries of the San Juan River in southeast Utah.
